1. Introduction

These Terms and Conditions (“Terms”) govern your use of the services offered by Imara Africa Safaris (“Company,” “we,” “us,” or “our”), a safari tour operator registered in Kenya. By making a booking or using our website, you (“Client,” “you,” or “your”) agree to be bound by these Terms. Please read them carefully before confirming any reservation.

2. Booking Terms

A booking is confirmed once we receive a signed booking form, the required deposit payment, and issue a written confirmation. All bookings are subject to availability. The lead traveller must be at least 18 years of age and accepts these Terms on behalf of all persons named in the booking.

It is your responsibility to ensure all information provided — including names, dates of birth, and passport details — is accurate. Errors arising from incorrect information may result in additional charges.

3. Payment Terms

A non-refundable deposit of 30% of the total tour cost is required to confirm your booking. The remaining balance must be paid no later than 60 days prior to the departure date.

For bookings made within 60 days of departure, full payment is required at the time of booking. Payments may be made by bank transfer, credit card, or other methods we make available. All prices are quoted in US Dollars (USD) unless otherwise stated.

We reserve the right to adjust prices due to currency fluctuations, changes in park fees, fuel surcharges, or government-imposed taxes. Such adjustments will be communicated before final payment is due.

4. Cancellation Policy

All cancellation requests must be made in writing. The following cancellation fees apply, calculated as a percentage of the total tour cost:

• More than 90 days before departure: deposit forfeited
• 60–90 days before departure: 50% of total cost
• 30–59 days before departure: 75% of total cost
• Less than 30 days before departure: 100% of total cost
• No-show: 100% of total cost

We strongly recommend purchasing comprehensive travel insurance that covers trip cancellation. If we cancel a tour for reasons within our control (other than force majeure), you will receive a full refund or the option to rebook.

5. Travel Insurance

Comprehensive travel insurance is mandatory for all clients. Your policy must cover, at minimum: trip cancellation, medical expenses and evacuation, personal accident, luggage loss, and repatriation. Proof of insurance may be requested before departure.

Imara Africa Safaris shall not be held liable for any costs arising from inadequate or absent insurance coverage.

6. Limitation of Liability

Imara Africa Safaris acts as an intermediary between you and various service providers including hotels, lodges, camps, airlines, and ground transport operators. While we exercise due care in selecting our partners, we shall not be liable for any injury, loss, damage, accident, delay, or irregularity caused by the acts or defaults of third-party service providers.

Safari activities involve inherent risks associated with wildlife encounters and remote environments. You participate in all activities at your own risk. Our total liability, where applicable, shall not exceed the total amount paid for your tour.

7. Force Majeure

We shall not be liable for any failure or delay in performance of our obligations caused by events beyond our reasonable control, including but not limited to: natural disasters, epidemics or pandemics, war, terrorism, civil unrest, government actions or travel advisories, strikes, severe weather, volcanic eruptions, or wildlife-related closures.

In such events, we will endeavour to offer alternative arrangements or credits for future travel. Refund policies under force majeure are at our discretion.

8. Passports, Visas & Entry Requirements

It is your sole responsibility to ensure you hold a valid passport (with at least six months’ validity beyond your travel dates) and any required visas, travel permits, or entry documentation for all countries on your itinerary.

Imara Africa Safaris shall not be held responsible for any consequences arising from your failure to obtain the necessary travel documents. No refund will be provided if you are denied entry to any country.

9. Health Requirements

You are responsible for consulting your physician or a travel health clinic regarding recommended vaccinations, malaria prophylaxis, and any health precautions for your destinations. Proof of Yellow Fever vaccination may be required for entry into certain countries.

You must disclose any medical conditions, dietary requirements, or physical limitations at the time of booking that may affect your ability to participate in safari activities.

10. Itinerary Changes

While we make every effort to operate tours as advertised, itineraries may be modified due to weather, road conditions, wildlife movements, park authority decisions, or other operational considerations. Such changes are made in the interest of your safety and overall experience.

Wildlife sightings cannot be guaranteed. We will use our best efforts and expert knowledge to maximise your experience, but nature is unpredictable.

11. Photography Consent

Photographs or videos taken during your tour by our guides, representatives, or fellow travellers may be used for marketing, social media, and promotional purposes unless you notify us in writing before or during the tour that you do not consent.

12. Dispute Resolution

Any disputes or complaints arising from your booking or tour should be raised with us in writing within 14 days of the completion of your trip. We will endeavour to resolve all matters amicably. If a dispute cannot be resolved through negotiation, it shall be referred to mediation and, if necessary, arbitration under the laws of Kenya.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Kenya. Any legal proceedings shall be subject to the exclusive jurisdiction of the courts of Kenya.
